Anniversary: 12/5/1996 I withdrew $40,000.00 cash from my Citibank Insured Money Market Savings Account with Management Approval at the 3rd Ave & 46th Street branch teller window under the impression that the money would not be released to me unless the loan applications I had made in prior months in the name of 21st Century Digital and my person had been approved.

There's a posting under "My Posts" on 12/6/2008 which tells the story of 12/5/1996 and 12/6/1996 when I withdrew the $40,000.00 cash at the teller's window (see Management Approved Withdrawal Slip). As the Certificate of Disposition it shows, the case was finally dismissed on 4/5/1999 after being called 4/07/1997, then 4/06/1998.

On 12/6/96, during the arrest, NYPD confiscated a number of items from my apartment, including my Toshiba laptop computer from which I ran my business. There were a handful of property vouchers, this is one. It took a couple of months to get the laptop back.

This is one of a handful of property vouchers of what was taken as a result of the Grand Larceny Allegations/investigation.

I don’t blame anybody…there's human error and there's confluence of circumstances and there's systematic protocol. But this was really a mess.

April 5th 1999 when the docket was called it was finally dismissed. I filed materials that day with the court too.

My November 1996 statement for the account from which I withdrew the funds in December.

 I had no money in the account in November 1996….

……and then I deposited the checks from the accounts on which I had pending loan applications on Monday December 2. On December 3rd and 4th I called the credit offices at Citibank (which were making the decisions on the loan applications) to indicate that I had done this very act based on the pending loan applications, and that if the loans were not approved I'd pay the bounced check fee and then I'd take my business, TTS Industries and the soon to be formed Twenty First Century Digital- to another bank for initial financing.

 On December 5th when I went to the branch, each check had been paid in full, so there was $75,000.00 in the account.

 I withdrew the $ 40,000.00 as seed capital I didn’t want sitting in a bank account- wanted to bargain to put it somewhere to secure more start up funds during 1st round 1997-8 21st Century Digital financing.

 The statement shows that I withdrew $40 K on the 5th….and that then the bank debited $34 K on the 10th, 5 days after the arrest and closed the account.

I filed a complaint with the Office of the Comptroller of the Currency during 1997. I've never understood how the funds could have been available to me as cash to withdraw at the teller window with management approval - that the check didn’t bounce- if my loan application had not been approved.

 In fact, the checks I deposited were in denominations that the $ 40,000.00 could not have been availab...le unless each check cleared. The two Citibank checks listed on this page were accounts established at the very same branch where they were deposited, and the very same branch where the withdrawal was made, and the very same branch where the account from which the withdrawal was made was established- all at the branch at 46th and 3rd in Manhattan.

Today, in 2008, I have established the accounts for21st Century Digital and TTS Industries at the very same Citibank branch, which is around the corner from my apartment and around the corner form Grand Central Station Post Office, where I get my business mail. But there was a while when I was prohibited from opening a bank account nationwide as far as I could tell, due to the existence of the felony grand larceny allegation. On the date of the withdrawal, I went to the branch twice…once in the morning, when I was told that I'd need to see the branch manager before conducting the transaction. During the course of the day I spoke with several representatives in credit and customer service. I went back to the branch in the afternoon, when after waiting at the tellers window I was instructed to sit with a management representative. We filled out a significant number of forms, and I was told that the transaction was complete…counted the money and left.

During 1997, I took the LSAT and was admitted to Brooklyn Law School. I matriculated in August 1998. But I could not get a bank loan to finance Brooklyn Law. I matriculated at Brooklyn Law School August 17th 1998 while trying to get financing, but was withdrawn for failure to remit tuition in early September. In October of 1998 the lease on my apartment expired, and I could not afford to renew the... lease….At this point, the charges had not been officially dismissed. The docket had been called in April 1998, and was scheduled to be called again April 1999. I had been planning on studying for the next three years. I lost my lease, and, subsequently, I lived outside without domicile from November 1998 through January of 2005. Most of that time I camped on the beach in East Hampton Southampton, and Fire Island.

At the time, I felt strongly that the actions of the bank adversely effected my business initiative, souring my plan to bring 21st Century Digital Public with an IPO scheduled for President's Week 1998. I filed a claim with the Federal Reserve Bank on October 5th 1998 with my comments on the Proposed Citicorp-Travelers Group merger, which merger was consummated 3 days later on October 8th 1998.

There were some severe complications resultant attorney representation during the 1997 larceny allegations, to the extent that- in the 60 days between being dismissed from Brooklyn Law School in September 1998 until I could not renew my lease upon expiration November 1998- I filed a complaint against the attorney who had been handling my defense. Confusions and lack of expertise contributed to certain mishandlings in motions, pleas, evidence , communications, and finances pertaining to the docket.

 I filed materials with the Departmental Disciplinary Committee. I had not yet studied law. My Undergraduate degree was Liberal Arts at SUNY Stony Brook on Long Island. I felt strongly enough about the mishandlings that by the last day I held a lease in 1998 I was writing a follow up letter to the First Department Appellate Division. I filed a number of documents that Halloween week of 1998. I also established TMTP USA Unlimited, my third Sole Proprietorship, that week.

 I spent $399 for a 30 day Amtrak North America Rail Pass, went to Whitefish, MT, then Bellingham, WA, then South Texas for a bit. Eventually I was back in court April 1999 when the charges were finally dismissed in Manhattan Criminal Court.

 On 14 occasions between 1999 and 2005 charges brought against me for camping or violating the hours of operation of a park in East Hampton, Southampton, and Manhattan were dismissed. I was never charged on Fire Island.

 

 Two months on Fire Island I rented a room during the winter of 2001 , but apart from that 365 days a year I slept outside from 1999-2005, well over 1500 nights, in East Hampton Village, Southampton Village, and the NY City. In Manhattan I mostly used PANYNJ Pier 34, but I also used Jacob Riis Park in the Rockaways, Central Park, and a park near the GW Bridge. I kept my equipment and possessions in storage facilities in each place. I maintained inexpensive gym memberships in each place, where I'd shower without fail every day. Most of the time I was on a very tight budget- I cooked all my meals using an MSR stove (lots of oats, pasta, potatoes, etc). I was never ticketed for doing so.

I pled guilty to camping in 3 court proceedings, one in East Hampton, one in Manhattan, and one in Southampton described below.

 I truly slept well outside, staying in the very same park or beach year round where these violations occurred: on PANYNJ Pier 34, Old Towne Beach in Southampton, and between Main Beach and Wiborg Beach in East Hampton. When I was ticketed, I'd continue using the same locale during the course of proceedings which generally went on for months.

The Pier was actually locked every night from 11 PM till 6 AM, and regularly patrolled by the Port Authority of New York and New Jersey Police. I slept soundly every night about 1500 yards out into the Hudson at the end of the Pier, within site of PANYNJ Patrol Gate.

I was almost never on the Pier during the day during those years, just at night to sleep. I have an album on FB title PANYNJ with some pics of the Pier.

My budget during those years was truly prohibitive insofar as achieving domicile on my own…prior to September 11th I slept year round on Pier 34 in Manhattan, the Port Authority pier that gives access to the Holland Tunnel ventilation tower. On occasion I would be given a summons for violating the hours of operation of the pier. I answered every... summons, and each was dismissed in Manhattan Criminal Court. In the mornings, I'd put my sleeping bag in Manhattan Mini-Storage on Spring Street, and then go cook my meals-usually eggs or oatmeal- at the picnic tables at Spring and Thompson in SoHo. Then I'd shower either in Central Park at the Tennis Courts or Ballys gym. I have all the Court papers from that in my files too

During Spring, Summer and Fall 1999 I worked for the Chamber Music Society of Lincoln Center telemarketing for the Chamber Music Society's 1999-2000 Season at Alice Tully Hall every night from 5-9, then I'd camp on the Pier. I saved the money to buy tarps, etc...

 I am in complete agreement with the prerogative of law enforcement agencies and courts to exercise authority to prosecute and penalize for violations of ordinances prohibiting camping without a permit or violating the hours of operation of any park or locale. In no instance have I challenged that prerogative. Rather, I made the case that I was camping due to a set of extenuating circumstances.

In each of the 17 proceedings I was in front of multiple Judges on numerous occasions, and a host of District Attorneys prosecuted the cases.

I was camping of my own volition given my love for the sport and extenuating circumstances. These violations were appropriately adjudicated in court in accordance with protocol and in keeping with applicable jurisprudence.

SoHo at Spring and Thompson Street on a wet afternoon about Year 2000.

Prior to September 11th I slept year round on Pier 34 in Manhattan, the Port Authority pier that gives access to the Holland Tunnel ventilation tower.

In the mornings, I'd put my sleeping bag in Manhattan Mini-Storage on Spring Street and Varick, and then go cook my meals-usually eggs or oatmeal- at the picnic tables at Spring and Thompson in SoHo. Then I'd shower either in Central Park at the Tennis Courts or Ballys gym.

The entrance to the SoHo DKNY is across the street from the park. I was there every day for a meal for over a year. During inclement weather I'd rig a tarp so that rainfall wouldn’t interrupt that meal. A tenant in the building took this photo and gave it to me.

Every day I filled my dromedary bag with water at the Central Park Tennis Courts or Soho Firehouse, then I'd retrieve my cooler and trunk full of dry goods like pasta and oats and wheel them on my hand truck to Spring and Thompson and cook. The dromedary bag is hanging on the hand truck.

 In 2008, I play lacrosse in this park at Spring and Thompson, keep the lax stick in the storage at Spring and Varick, along with boxes of files.

MSR makes a great camping stove. This model, the Whisper Lite, boils a liter of water in under 4 minutes, and can be adjusted from ultra hot to simmer with the turn of a valve. By 2005, I had 2 of these in each of Southampton, East Hampton, and Manhattan in a kit that was set up to make pretty good meals without taking too much time, as my schedule got busier and busier and my budget was growing.

In no instance have I challenged that prerogative. Rather, I made the case that I was camping due to a set of extenuating circumstances. In each of the 17 proceedings I was in front of multiple Judges on numerous occasions, and a host of District Attorneys prosecuted the cases.

I was camping of my own volition given my love for the sport and extenuating circumstances. These violations were appropriately adjudicated in court in accordance with protocol and in keeping with applicable jurisprudence.

Most of these cases I represented myself Pro-Se. For the docket which began soon after September 11th I was assigned an 18-B Attorney, which in the end was good and bad. In the end, I pleaded guilty.

On November 17 2003 I pled guilty in Manhattan Criminal Court to non-criminal trespass October 4, 2001 in Riverside Park on the Hudson River in Manhattan (proximal to the George Washington Bridge)... for camping without a permit. I was sentenced to the time served while in NYPD custody for arrest processing.

I am in complete agreement with the prerogative of law enforcement agencies and courts to exercise authority to prosecute and penalize for violations of ordinances prohibiting camping without a permit or violating the hours of  operation of any park or locale. In the aftermath of September 11th, the Pier and all the area around it was off limits. But all my gear was in the Manhattan Mini Storage at Spring and Varick (across from Trump SoHo, which is now being built). So there was a time that I traveled to Jacob Riis Park in the Rockaways via subway and bus daily to camp, then came back to SoHo to cook, then to Ballys to shower. My budget was prohibitive... of switching up too much. I couldn’t sleep in the street or some doorway- literally I could not sleep. So I never did it. The Pier did the trick, as did the beach. Although Riis was a little spooky. I had ongoing Court matters to attend to, and a tough budget.

 In 99, 2000, 2002, and 2002 I devoted the income from carpentry to gear like gloves, boots, tarps, stakes, stoves, and transcripts, printing, storage, etc...it wasnt until 2003 that I bought a tent as per below

The dune grass where I camped for a few years every night was growing back in 2007 when I took this picture…but since then a lot of this dune eroded during winter 2007-2008. I never left any garbage or waste- not a morsel- on the beach or on the pier or in any park day or night. I carried out what I carried in without fail, including any and a...ll waste.

Actually, I never pitched a tarp in the dune. Prior to 2003 I never climbed the dune. I was in this same spot but just below the dune, where I'd pitch a tarp at night. After I bought the tent in 2003 I cleared a little dune grass and started pitching the tent up there.

Just before the 2001 Hamptons International Film Festival, and a few weeks following September 11th, on October 4 2001, I had to come into Manhattan from Southampton to retrieve funds and get my mail at my Grand Central Station Post Office Box. Without access to Pier 34 for the first time following September 11th, I slept in a City Park just near the GW Bridge. In the middle of the night I was arrested by NYPD, and charged with trespassing in a park and disorderly conduct. The case went on until winter of 2003, when I finally just pleaded guilty. I was sentenced to the time served while in NYPD custody for arrest processing.

I don’t have many pictures from this era…this is in October 2001, during the Hamptons International Film Festival, a few weeks after the incident described above near the GW Bridge in Manhattan.

I worked for the festival that year, picking up film producers and directors at JFK in an SUV and driving them to the festival headquarters at The Huntting Inn, then to the screenings and then to the after-parties. Finally, I'd park the SUV at The Huntting Inn and ride my mountain bike down to Wiborg Beach where I'd set up a tarp near the dunes.

From 2002-2004 I worked at the Hampton Jitney. I'd work a bus from Southampton into the Manhattan and back, then at night get my backpack and mountain bike from Hampton Self Storage and ride down to either Old Towne Beach in Southampton or Wiborg Beach in East Hampton. Eventually I bought a tent, and then two back up tents as well as lots of down sleeping bags and gear, including back up camping... stoves.

During 1999 and 2000 I was able to find work as a builder's helper/laborer for wages, mostly on Fire Island during the winter. I'd camp on the beach, and then meet my boss at the job site in the morning, work all day, then go down to the beach, cook my dinner on a camping stove, set up camp, etc.

In 2005 I had three camping on the beach cases in East Hampton that were dragging on for several months. I decided to plead guilty to one count of camping on the beach in a plea bargain- I paid a $250 fine and agreed not to camp on the beach for a year, after which the other two counts of camping on the beach were discharged.

 

 With the help of my parents, I moved into a studio on Manhattan's Upper East Side. I got a job at Bear Stearns in the Anti-Money-Laundering Department, where I worked for a year while I applied to law schools. I was admitted to New York Law School with a $20,000.00 scholarship. Of course I had to disclose the bank incident and every charge of any violation of any law, including camping etc.

February 28th, 2005 I pled guilty to two counts of camping on the beach in East Hampton. One other count of camping on the beach was conditionally discharged if I did not camp on the beach in East Hampton for 12 months.

From September 1999 (Hurricane Floyd) through May 2003 I did not own a tent. Instead, I purchased a series of different sized tarps, stakes, and ropes as my budget allowed. On the beach or the Pier I simply guyed out a tarp.

But by May 2003working on the Jitney, I finally bought this tent, a North Face Himalayan 47. Shelter! Wow was that something else to have going into winter 2003. Tarps are a lot of work, and variant weather can interrupt a night's sleep.

The first year or two was kind of rough insofar as budgeting…I became adept at guying out a tarp on the beach with ropes, etc.

When I started making money at carpentry and at the Jitney, I probably could have moved into a cheap apartment. But I wanted to make sure that I put the money I earned into products that I would then own, and that would directly improve my health and well being in the si...tuation I was in.

 In the next year or two, I bought the best, warmest sleeping bags, boots, etc, and then best tents, and best gore tex available. Wow!

 By 2005, I was confident that I'd be able to guy out a tarp for shelter, even if something happened to either of my three North Face Expedition Grade Four Season Tents….and I had back-up stoves for my back-up stoves, and storage facilities in East Hampton, Southampton, and Manhattan, each with a tent in it and multiple sleeping bags and stoves and tarps.

 I still own all the equiptment, and all the North Face and Patagonia Lifetime Warranties are stil in tact.

There's been significant erosion on the dune between Main Beach and Wiborg during the course of 2000 and 2006. The dune grass on the perch where I set camp was replenishing in 2006, but erosion has since encroached, converting this dune ridge into basically flat beach. But before that, 24 hours a day this dune was at least 20 yards above the high tide water line. You can get a decent workout setting up a tent on a dune during a nor'easter at night. I wrote an application essay about that, posted on FB under title "Pitching a North Face Himalayan 47"

It got pretty cold during the winters, particularly in January and February. So cold, the beach sand gets as hard as cement- steel stakes can't even be hammered into the sand its so solid. After several months working at the Hampton Jitney, I purchased a North Face Himalayan Suit, marketed as "The Warmest Suit on the Planet". The one pictured is red, but mine is Gold and Black. I'd ride my mountain bike from the Jitney down to the beach wearing fleece and gore-tex, hike half a mile with my back pack, and then throw on the Himalayan Suit and set up camp, cooking a full meal….every night for several winters. Great exercise, lots of skills acquired.

 The dune grass where I camped for a few years every night was growing back in 2007 when I took this picture…but since then a lot of this dune eroded during winter 2007-2008. I never left any garbage or waste- not a morsel- on the beach or on the pier or in any park day or night. I carried out what I carried in without fail, including any and all waste.

Actually, I never pitched a tarp in the dune. Prior to 2003 I never climbed the dune. I was in this same spot but just below the dune, where I'd pitch a tarp at night. After I bought the tent in 2003 I cleared a little dune grass and started pitching the tent up there.

I was almost never on the beach during the day during those years…just at night to sleep.
