This document, carrying form ____ supplements DMRs statement to NYHESC that Administrative Wage Garnishment of DMRs wages is unjust and should not be in place and/or if in place should be removed and/or if instituted should be reduced. Therefore this notice by DMR January 2015 to NYHESC supplements DMR filings at ACS Xerox, Sallie Mae, Navient, NYHESC, US Dept of Education made:
DMR states that in 2014 average weekly takehome pay after taxes was $ 580.00 ; at the end of 2014, after receiving a $ 1.00 wage increase during November 2014, DMR's wages are $ 15.75. The majority of 2014 DMR's wages were $ 14.75 per hour. DMR worked 224 overtime hours during 2014, an average of 4.3 hours overtime per week. Monthly average takehome pay during 2014 was $ 2320
DMR states that a 15 % wage garnishment will present a financial hardship.

Note: NYHESC as proxy to US Dept of Admin insofar as ability to Review , which in fact is or seems to bear the semblance of an ajudication following due process. Here, DMR states that NYHESC fails as proxy insofar as an operational process in practice which rises to status of substitute for ajudication in law of contractual dispute.
one major question presented is as to whether NYHESC processes amount to due process substitute for litigation comporting with congressional mandate, and whether the analyses prior to garnishment was correct and weighed any items of fact. This, insofar as DMR, and this, insofar as full portfolio of analyses, and subject matter passed from any servicer to NYHESC. This includes analysis of servicer operational policy insofar as fact gathering and circumstances presented during years of servicing, comporting with Dept of Ed mandate and standards of Federal Agency.
